In Missouri, the damages available to the family in a wrongful death case are outlined by statute. Missouri law states that the family members entitled to bring the claim may recover damages for funeral expenses and medical bills as well as the reasonable value of “consortium, companionship, comfort, instruction, guidance, counsel, training, and support” that was provided by the decedent to the family members. While it’s often difficult for a jury to separate when awarding compensation, damages for a family’s grief and bereavement are technically not recoverable. 


In cases where the decedent does not pass away immediately after the accident, the family may also recover any damages the decedent suffered from the time of the accident until their death (this often includes medical bills and pain and suffering experienced by the decedent).
