That means you pay nothing upfront and your attorney only gets paid if they recover money for you. Many mid-Missouri personal injury firms work on a sliding scale fee structure, with your attorney’s fee percentage increasing if the case is resolved after a lawsuit is filed. A common attorney fee structure is 33 & 1/3 of the total settlement if the case settles pre-suit and 40% of the total settlement if litigation is required.

2. CASE EXPENSES


Case expenses are the out-of-pocket costs required to properly investigate, build, and pursue your personal injury claim. These are not attorneys’ fees, but separate litigation costs such as obtaining medical records and bills, filing fees with the court, deposition transcripts, expert witness fees, and other evidence-related expenses. In most Missouri personal injury cases, these expenses are advanced by your attorney during the case and then reimbursed out of the settlement at the end. While they vary depending on the complexity of the case, they are a necessary investment to maximize the value of your claim.


Expenses typically range from $500 to $5,000+ (however, costs can be much higher for catastrophic injury and wrongful death cases).

3. MEDICAL BILLS, MEDICAL LIENS, AND HEALTH INSURANCE REIMBURSEMENT


One of the biggest factors affecting how much money you actually receive from a personal injury settlement in Missouri is how medical expenses are handled. This includes not just your medical bills, but also medical liens and health insurance reimbursement claims (often called subrogation).


If you received treatment after your accident and those bills remain unpaid, they will typically need to be satisfied out of your settlement. Even if providers have not sent your account to collections, they often expect payment once your case resolves. This may include:


  • Emergency room treatment
  • Hospital stays
  • Physical therapy
  • Chiropractic care
  • Follow-up care or specialists


In many cases, healthcare providers will assert a lien against your personal injury settlement. A lien means the provider has a legal right to be paid directly from your recovery. Missouri law specifically addresses this through
RSMo. § 430.230, which places important limits on these claims. It’s important to note that medical providers who assert a lien cannot take more than 50% of the remaining settlement after attorney’s fees and expenses are deducted. If multiple providers assert liens, they must typically share proportionally. However, these liens are often negotiable and reducible, especially with experienced legal representation. 


Finally, if your health insurance paid for your treatment, the insurance company may assert a right of reimbursement (called subrogation). Common health insurance plans that must be reimbursed include employer-sponsored ERISA plans, Medicare, Medicaid, and Tricare.

4. PERSONAL INJURY SETTLEMENT LOANS


If you’ve been injured and are waiting on your case to settle, you may have seen advertisements offering “cash now” in exchange for a portion of your future settlement. These are commonly called personal injury loans or pre-settlement advances.


A personal injury loan is not a traditional loan. Instead, it is a cash advance against your expected settlement. You receive money upfront while your case is pending, and the loan company is repaid only if you recover money. If you lose your case, you typically owe nothing (non-recourse).
